Guardianship Proceedings In Nassau County

A guardian for an incapacitated person is appointed by the court. He or she has the power to make legal decisions for the incapacitated person. This can include decisions on real estate transactions, investments and where the incapacitated person will live.

In New York, guardianships of incapacitated persons are considered under Article 81 of the Mental Hygiene Law. A hearing in Supreme Court is required, with the Court appointing an evaluator to determine the person's mental facilities.

The parties are allowed to be represented by attorneys. This is especially important when the allegedly incapacitated adult is contesting the guardianship. We will utilize expert witnesses and other resources to establish your case, whether you are seeking the guardianship or contesting it.
