What is considered when making child custody decisions?

If there is one thing that can immediately bring divorce settlement negotiations to a standstill, it is deciding who will get child custody or visitation. Developing an agreement that is in the best interest of the child and that the parents agree with can be very difficult in some cases.

When decisions over custody and visitation need to be made, there are several factors that must be considered. These include:

-- The parent's ability to take care of the child

-- The parent's lifestyle

-- The way that care-giving duties were split while married

-- How the custody decision will impact the child in terms of schooling, extracurricular activities, friends, religion and more

-- The emotional bond between the child and each parent

-- The preferences of a child who is older

At Weinstein, Kaplan & Cohen, P.C., we work diligently to ensure that the child custody arrangements will allow the child time with both parents. We prefer to work out such arrangements through arbitration, mediation or negotiation; however, we are experienced litigators who can skillfully represent your interests in court.

Child custody is an incredibly important part of the divorce settlement. Understanding what is best for the child is vital to the success of any custody and visitation agreement. Having access to all records involving the child can help, as can witnesses who know the child and parents.
